1. Eligibility & Registration

  • Local Area: Vendors must be based in the Moreton Bay region or demonstrate a significant creative connection to the area.

  • Account Security: You are responsible for maintaining the confidentiality of your account login details.

  • Business Details: To keep our Moreton Bay marketplace transparent and compliant with Australian law, every vendor must provide accurate store details. One of the first steps is identifying how you operate in Australia.

    Option A: The Hobbyist

    You are likely a hobbyist if you create your handmade goods for personal enjoyment and sell them occasionally without the primary intention of making a profit.

    • Tax: You generally don’t need an ABN, and you don’t report your income to the ATO.

    • Requirement: You must provide us with a signed “Statement by a Supplier” form (a simple ATO document) so we don’t have to withhold tax from your sales.

    • Consumer Law: Even as a hobbyist, you are still required to provide items that match their description and are safe.

    Option B: The Business

    You are likely a business if you have a set intent to make a profit, you work at your craft regularly, and you operate in a “business-like” manner (e.g., you have a brand name, product branding, or a consistent stock level).

    • ABN: You must provide a valid Australian Business Number (ABN).

    • GST: If your turnover exceeds $75,000, you must be registered for GST.

    • Consumer Law: You must strictly adhere to all Australian Consumer Law guarantees, including repairs, replacements, and refunds for faulty goods.

    Regardless of your status, your store profile must include:

    • Legal Name: Your real name or registered business name.

    • Location: Your suburb within the Moreton Bay region (to verify local status).

    • Contact Method: A valid email address so we (and your customers) can reach you.

    • Accurate Descriptions: A product description is a promise. Because our customers can’t touch or smell your products through a screen, we rely on you to provide clear, honest, and detailed information for every listing.

 

2. Code of Conduct 

Whether you are a hobbyist or a full-time business, everyone plays by the same rules. The Code of Conduct ensures that every maker—regardless of size—is held to the same standard of honesty, transparency, and compliance with Australian Consumer Law.

  • Australian Consumer Law (ACL): You acknowledge that you are a “supplier” under the ACL. You must ensure your products are of acceptable quality, fit for purpose, and match their description.

  • Safety Standards: Vendors are solely responsible for ensuring products meet Australian mandatory safety standards (e.g., toys, cosmetics, or furniture).

  • Product & Communication Standards: 

    • Handmade Authenticity: All products listed must be made, designed, or significantly altered by you. We are a “Moreton Bay Local” marketplace; reselling mass-produced commercial items is strictly prohibited.

    • Honesty in Lead Times: To keep customers happy, your “Processing Time” must be accurate. If a custom order is going to take longer than stated, you must message the buyer within 24 hours to provide an update.

    • Packaging Standards: Items should be packed securely to survive the journey across Australia. We encourage the use of eco-friendly materials (honeycomb wrap instead of bubble wrap) to align with our region’s commitment to our natural environment.

    • Professional Communication: Vendors agree to respond to customer inquiries within 2 business days. Friendly, helpful communication is what keeps shoppers coming back to our collective!

     

3. Fees and Payments

  • Commission: I Market Things in Moreton Bay charges 10% commision on the total sale price (including shipping) of each transaction.

  • Payment Processing: We use PayPal to process payments. Funds will be released to your nominated Australian bank account after a 30-day holding period to account for potential returns.

  • Taxes: You are responsible for managing your own GST obligations. Our platform fees are inclusive of GST.

 

4. Shipping & Fulfilment

  • Fulfilment: Vendors are responsible for packaging and dispatching orders within the timeframe stated in their listing.

  • Proof of Postage: We strongly recommend using tracked shipping. In the event of a “not received” dispute, the Vendor must provide valid tracking information.

  • Packaging: Vendors must ensure items are packed securely. 

 

5. Returns, Refunds & Disputes

  • Policy Compliance: Vendors must honour the marketplace-wide Returns & Exchanges Policy.

  • Faulty Goods: Under the ACL, if a product is faulty, you must offer a repair, replacement, or refund.

  • Change of Mind: Vendors may choose whether to accept “change of mind” returns. 

 

6. Intellectual Property

  • Your Content: You retain ownership of the photos and descriptions you upload. However, you grant I Make Things in Moreton Bay a non-exclusive license to use this content for marketing and promotional purposes (e.g., Social Media, Newsletters).

  • Infringement: Vendors must not list items that infringe on the IP (copyright or trademark) of others. 

 

7. Relationship of Parties

  • Independent Contractor: Nothing in these Terms creates a partnership, joint venture, or employer-employee relationship. Vendors are independent creators and are responsible for their own insurance, taxes, and business expenses.

 

8. Termination

  • By Vendor: You may close your shop at any time, provided all outstanding orders have been fulfilled.

  • By Marketplace: We reserve the right to suspend or terminate accounts that breach these terms, receive repeated customer complaints, or engage in fraudulent activity.

 

9. Indemnity

You agree to indemnify I Make Things in Moreton Bay against any claims, damages, or legal costs arising from your products, your breach of these Terms, or your violation of any Australian law.
